2. QUIEN PUEDE PARTICIPAR:

3. ELIGIBILIDAD
A. Empleados de las Estaciones de Radio WCMQ-FM; WXDJ-FM Y WRMA-FM cada una, una “Estacion”), Spanish Broadcasting System, Inc. Sus afiliadas, y sus agencias de relaciones publicas, auspiciadores participantes y miembros de su familia (familia se considera como esposa o (a), padres, hijos, hermanos o hermanas, tías, tíos, primos, primas y abuelos o abuelas) no son elegibles
B. Un premio por ganador y su familiar inmediato (familia se define como esposos, padres, hijos, hermanos, tíos, tías, primos y abuelos y/o cualquiera que viva en la misma dirección) por un periodo de 60 días.
C. Cualquier individuo que gane $600 o más en un año se le pedirá que presente una tarjeta valida de Social Security o su número individual de contribuyente (ITIN) y una identificación hecha por el Gobierno, con su foto, que tenga la dirección individual. OFFICIAL CONTEST RULES & REGULATIONS FOR
“411-PAIN – TOYOTA SCION GIVEWAY” (the “Contest”)
1. NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. VOID WHERE PROHIBITED.
2. WHO MAY PARTICIPATE/ELIGIBILITY
A. Contestants must be at least 18 years of age to participate and have a valid Florida Driver’s License.
B. Employees of radio stations WXDJ-FM, WCMQ-FM and WRMA-FM (collectively, the “Station”), Spanish Broadcasting System, Inc., 411-Pain, their affiliates and their public relations agencies, participating sponsors, members of their “family” or “household” are ineligible to participate or win. “Family” is defined as spouse, parents, children, sibling, aunts, uncles, cousins and grandparents. Household is defined as anyone living at the same address.
C. One qualifier per “family” or “household” (each as defined in subsection 2(B)).
D. Any individual who wins a prize valued $600 (six hundred dollars) or more must provide the Station with valid identification and a valid TIN or social security card and number, and a valid government-issued photo identification which contains the individual’s current address before any prize will be awarded. Failure to present the foregoing identification may result in a disqualification of the winner, in which case the prize shall be forfeited.
E. If a winner selected is later determined by the Station to be ineligible, no prize will be awarded to the ineligible contestant and the Station reserves the right to award the prize to a qualified contestant.
F. There is no limit to the number of times a listener may enter the Contest, but a listener may only be a qualifier once.
3. HOW TO ENTER AND WIN:
Beginning Thursday, August 19th 2010 through Wednesday, September 29th 2010 between the hours of 6:00AM and 12:00AM, Monday-Friday, listeners will have the opportunity, upon hearing the DJ’s cue to call, to call-in to the Station’s listener line at (305) 550-9595. Each time, a designated caller (e.g. caller #9) will be qualified at participate in the grand prize drawing. The qualifier will be announced live on-air by one of the radio station DJs and will receive an invitation to participate in the grand prize drawing on Thursday, September 30, 2010. Five (5) listeners per day, Monday-Friday, for a total of one hundred fifty (150) listeners, will be qualified to participate in the grand prize drawing. Each qualifier will be required to provide his or her first and last name, complete address, telephone number and date of birth when he or she qualifies. The Station is not responsible for telephone outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his or her telephone call.
On Thursday, September 30, 2010, the qualifiers will be invited to Kaffe Krystal, 10855 Southwest 72nd Street Miami, FL 33173, at 9:00PM to participate in a drawing for the grand prize. All qualifiers must register with the Station at the designated check-in area beginning at approximately 7:30PM ET and no later than 8:30PM ET on September 30, 2010 in order to be eligible to participate in the grand prize drawing. A contestant not present by 8:30 PM will forfeit his/her chance to win the grand prize. Each qualifier’s name will be assigned to a key, all keys will be placed in a barrel, and a winning key will be randomly selected from the barrel. The qualifier whose key is selected from the barrel will win the Grand Prize (see below) courtesy of 411-PAIN. Retail value of grand prize (see below) is $19,150.00
By participating in the Contest, participants agree to be bound by these Official Rules and the decisions of the Station whose decisions shall be final, binding and conclusive on all matters relating to this Contest. The Station reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Station believes has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner or qualifier status using fraudulent means. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Station’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Station deems appropriate. All decisions will be made by the Station and are final.
4. PRIZE/RETAIL VALUE:
One (1) lucky grand prize winner will receive (1) One 2011 Toyota Scion XB courtesy of 411-PAIN with a retail value of $19,150.00, including sales tax, tags and delivery fees. Vehicle VIN #________________.
No substitutions permitted except at the sole discretion of the Station, in which case a prize of greater or equal value will be awarded. The Station makes no warranty with respect to the Contest prize and is not responsible for cancellation or postponement of the Contest. The cash equivalent of any portion of any Contest prize is not permitted, except at the Station’s sole discretion. The Station will report value of prizes as required by law.
Winner will be solely responsible to all expenses with respect to vehicle title, proof of insurance, license and registration fees, emissions inspection, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of the prize vehicle. The winner will accept the prize vehicle “as is.”
5. ODDS OF WINNING.
The odds of being an on-air qualifier depend upon the timing and the number of calls received. The odds of being the grand prize winner depend on the number of qualifiers who attend the grand prize event.
6. RELEASE:
By participating in the Contest each participant waives any and all claims of liability against the Station, Spanish Broadcasting System, Inc., its subsidiaries, affiliates and participating sponsors and their respective employees, directors, shareholders and agents, from any and all claims, liabilities and damages arising directly or indirectly out of the award of the prize or that may be sustained directly or indirectly in connection with this Contest, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize or for any claims, liabilities, losses, repairs, damage or injuries arising out of or in conjunction with the services, merchandise or other benefits obtained by the winner or this Contest. In order to receive a prize, participants must sign an official waiver form provided by the Station. Winner must sign a participant release from provided by Station on September 30, 2010. Winner must also provide a driver’s license upon winning and any other restrictions required by Toyota Scion and/or 411-PAIN. Winner must also provide proof of valid car insurance under his or her name prior to receipt of prize.
7. REDEEMING OF PRIZE: All prizes must be redeemed or claimed within ten (10) business days at 7007 N.W. 77th Ave., Medley, Florida 33166 Monday through Friday between the hours of 10:00 AM to 5:00 PM.
8. PUBLICITY, USE OF PERSONAL INFORMATION:
By participating, all participants and winner(s) grant the Station exclusive permission to use their names, characters, photographs, voices, biographical information and likenesses in connection with promotion of the Contest and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that the Station may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
9. Any valuation of the prize stated above is based on available information provided to the Station, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Winner will be required to complete and submit an IRS Form W-9 with the winner’s Social Security Number or the equivalent. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize that is not specifically provided for in these official rules. Any person winning over $600 in prizes from the Station will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
10. Prizes may not be substituted, are not transferable, redeemable for cash or exchangeable for any other prize.
11. The Station reserves the right to award additional prizes throughout the Contest.
12. Any rule changes after the Contest begins must not disadvantage Contest participants and will be announced promptly and conspicuously.
13. The name of the listener that appears on the official/original entry form is the winner of that particular contest.
14. The Station disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express mail, or other delivery method. The Station is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed connections, traffic congestion on telephone lines.
15. Each winner must submit proof of eligibility and sign the Station’s release form to claim the prize. Void where prohibited. In the event the Station is prevented from continuing with the Contest or the integrity and/or feasibility of the Contest is severely undermined by an event beyond the Station’s control the Station may substitute prizes of equal or greater value or discontinue the Contest at any time. In no event will the Station be obligated to award more than the number of prizes stated in these Official Rules. The Station disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.
16. The conduct of the Contest is governed by the applicable laws of the U.S., which take precedence over any rule to the contrary herein. The Station shall follow the applicable laws for conducting the Contest, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
17. A copy of these rules and regulations are available during normal business hours at the station and at Station’s website at http://www.elzol.com and will be retained and available for public inspection at the Station’s offices located at 7007 NW 77th Ave., Medley, Florida 33166.

“EL BOMBAZO DE HEADQUARTER TOYOTA”

1. These rules govern the “La Bomba de Dinero de Headquarter Toyota” contest (the “Contest”) being conducted by WXDJ-FM, WCMQ-FM and WRMA-FM (the “Stations”) beginning on Wednesday, September 8, 2010 at 12:01 am and ending on Saturday, September 25, 2010 at 12:00 pm.
2. ELIGIBILITY
A. Contestants must (i) be at least 18 years of age to participate, (ii) have a valid Florida Driver’s License, and (iii) have a valid social security number and card, or a valid taxpayer identification number (“TIN”).
B. Employees of the Stations, Spanish Broadcasting System, Inc., its affiliates and their public relations agencies, participating sponsors and “family” members (“family” is defined as spouse, parents, children, sibling, aunts, uncles, cousins and grandparents) are ineligible.
C. One prize per winner from each immediate “family” (“family” is defined as spouse, parents, children, sibling, aunts, uncles, cousins and grandparents) and/or “household” (“household” is defined as anyone living at the same address) is allowed during the term of this Contest.
D. Any individual who wins $600 (six hundred dollars) or more must provide the Stations with valid identification and a valid TIN or social security card and number, and a valid government-issued photo identification which contains the individual’s current address before any prize will be awarded. Failure to present a valid social security card or TIN may result in a disqualification of the winner, in which case the prize shall be forfeited.
E. If a winner selected is later determined by the Stations to be ineligible, no prize will be awarded to the ineligible contestant and the Stations reserve the right to award the prize to a qualified contestant.
3. NATURE OF CONTEST:
A. Beginning Tuesday, September 8, 2010 through Friday, September 24, 2010, at designated times throughout the day, the Stations will solicit callers to "GANAR A EL BOMBAZO DE HEADQUARTER TOYOTA". When you hear the solicitation to “EL BOMBAZO DE HEADQUARTER TOYOTA,” you must dial one of the correct Contest lines at (305) 550-9200, (305) 550-9595, or (305) 550-9106. There will be one (1) qualifier chosen from all eligible callers each time the solicitation is aired (as solely determined by the station). The lucky qualifier will be announced live on-air by one of the Stations’ DJ’s and will have the opportunity to “GANAR A EL BOMBAZO DE HEADQUARTER TOYOTA” for cash courtesy of Headquarter Toyota (as detailed at Subsection 3C, below) and to participate in the Grand Prize drawing on Saturday, September 25, 2010.
B. On Saturday, September 25, 2010, the random qualifiers will be invited to Headquarter Toyota, 5895 Northwest 167th Street, Miami, FL 33015 between the hours of 10am to 12pm to complete registration process (must be present to win) to participate in a random drawing for the grand prize $5,000.00 in cash, courtesy of Headquarter Toyota. One (1) qualifier’s name will be randomly selected from all qualifiers who are present at the event, and that qualifier will win $5,000.00 in cash.
C. In addition to the opportunity to participate in the Grand Prize drawing (as detailed in Subsection 3B, above), when each designated qualifier is on the telephone line, the DJ on the air will play a designated, pre-produced “GANAR A EL BOMBAZO DE HEADQUARTER TOYOTA” Contest audio package on the telephone line to the designated caller. The object of the Contest is to have the designated qualifier say the word “Stop! or Para!” before the “Bomb” sound effect goes off. As the Contest audio package plays, dollar amounts between $5.00 and $300.00 will be announced in increasing increments of $5.00 to $25.00 each. If the designated qualifier clearly says "Stop! or Para!" before the "Bomb" sound effect goes off, the designated caller will win the last complete dollar amount announced. (If the designated caller says "Stop! or Para!" at any time during the announcement of a dollar amount, they will be awarded the dollar amount previously completely announced.) If the "Bomb" sound effect goes off before the designated caller clearly says "Stop! or Para!" (as determined by the Stations), the game is over and no dollar amount is awarded, but the qualifier still gets to participate in the Grand Prize event (see Subsection 3B). If the "Bomb" sound effect does not go off (except as a result of an error or malfunction) and the maximum dollar amount is announced without the designated caller saying "Stop! or Para!" the designated caller wins the maximum dollar amount. Subject to verification of eligibility and compliance with these Official Rules, each qualifier will receive his or her winnings in the form of a check on Saturday, September 25th, 2010 at the location of Headquarter Toyota. Should there be any dispute over whether a designated caller has said “Stop! or Para!” before a dollar amount was announced or before the “Bomb” sound effect goes off the Stations will make the decision of what prize, if any, will be awarded. Stations’ decisions are final.
D. The use of automatic telephone dialing equipment or other software or computer assisted dialing equipment is prohibited and will result in disqualification. Stations are not responsible for loss of service to the Contest line or for a contestant’s failure to reach the Contest line due to contestant error, malfunction of any network or system, congestion, overload, busy signals, or any other factor that may prevent an individual from completing his or her phone call, or any interruptions or technical difficulties including those that may prohibit, prevent, or interfere with the submission of an entry or completion of a phone call. In the event of an interruption of power or telephone service to Stations during a call-in time of the Contest and prior to accepting the designated caller, the Contest call-in period affected by the interruption may be replayed at the resumption of service, in Stations’ sole discretion. EACH PARTICIPANT ACKNOWLEDGES AND AGREES THAT ANY TELEPHONE CALLS PLACED TO THE STATIONS’ CONTEST LINE MAY BE BROADCAST LIVE ON STATIONS AND ALSO MAY BE RECORDED FOR USE ON AIR AT A LATER TIME.
E. By participating in the Contest, participants agree to be bound by these Official Rules and the decisions of the Stations, whose decisions shall be final, binding and conclusive on all matters relating to this Contest. • Up to twenty eight (28) qualifiers will win cash prizes between $0 and $300.00. The total combined value of all prizes awarded to qualifiers will not exceed $5,000. If the total amount awarded to qualifiers reaches $5,000 during the Contest period, no additional listeners will be qualified.
5. ODDS OF WINNING. The odds of winning depend on the number of eligible participants.
